User Account & registration Terms

No matter how you access the service, you must create a Dutybell user account (“Dutybell account”) to access and use our services. Hereinafter referred to as “registered user”.  Posting Rules:

 You may not post any Document to a Site that contains:

The posting must contain an accurate resume/CVs representing the living personnel they are looking for in full-time, part-time, freelance, work from home (WFH) based and contract work.

Dutybell is not obliged to monitor the documents published on the website, but it can trace these docuemnts at it level. Dutybell may, at its sole discretion, delete any documents that violate the above-mentioned publication guidelines.

If members continue to carry out this activity, the company has the additional right to terminate the membership of Dutybell.com and/or any other organization or suspend its membership. The exclusive company has the right to claim damages For compensation, the company has the right to sue and demand compensation for the loss and damage of the company’s goodwill caused by violation of such breaches.

Payment and Refund Policy

Payment for memberships

All service payments in Dutybell can only be made in favor of “Dutybell” and as the beneficiary. All payments must be paid 100% in advance to continue using the paid service without interruption. We do not authorize any individual or entity to collect payments for the services provided by Dutybell.Com in any other name (ie another individual or entity name).You can make payment through a PayPal account. Please note that under no circumstances will Dutybell.Com be liable for any damages for  caused by third-party payment processor,any individual fraudster or any organization. To protect your privacy, if a fraudster or organization tries to mislead you, please contact us immediately. If the company found that the dispute is caused by our third-party payment processor in this case the company will immediately intimate the issue to the third party payment processor. If the user defaults on the payment due under this agreement or non payment under stipulated time period(Within 15 days) the associated service will be cancelled/terminated.

Credit Card Billing

Credit card payments are processed by our third-party payment processors-PayPal. By accepting these terms of use, you agree to the PayPal terms of use. If you choose a subscription-based service or implement a payment plan, your credit card will automatically be charged for the service and applicable taxes on a monthly basis. If you choose to subscribe or have implemented a billing plan, the payment method and applicable taxes for online courses will be automatically calculated. If the fee is not paid on time or our processor is unable to use the provided credit card information to process your transaction, we reserve the right to close your account or block or terminate your access to online courses at our sole discretion. … If there is a change, your map provider can provide us with updated map data, and you agree that we can collect this data. Refund on the basis of fraudulent transactions

You are solely responsible for completing online or offline transactions using credit/debit cards or other forms. Tools or documents used to conduct these transactions, Dutybell.Com is not responsible for any misuse of information related to the use of credit/debit cards used through online or offline medium by subscribers.

Refund on the basis of change in preference / delay in process

Dutybell maintain active interaction with customers and execute the entire process with their consent. There is no provision for full or partial refunds. Suspension of Service

Dutybell is not responsible for the content or actual availability of certain advertising positions. DUTYBELL.COM DOES NOT PARTICIPATE IN ANY TRANSACTIONS OR COMMUNICATIONS, AND THEREFORE DOES NOT ASSUME ANY RESPONSIBILITY FOR ANY LOSS OR DAMAGE CAUSED BY THE USE AND/OR TEMPORARY OR PERMANENT INTERRUPTION OF ITS SERVICES. SINCE THE MOBILE APPLICATION IS SMALL AND LIGHTWEIGHT TO PROVIDE A USER-FRIENDLY EXPERIENCE, EACH CONTRIBUTOR DECLARES, WARRANTS AND AGREES THAT THEY ARE ACTUALLY ACCEPT AND WILL NOT BE PROMPTED TO INCLUDE SUCH FEATURES IN THE MOBILE APPLICATION VERSION. USERS AGREE TO TAKE FULL RESPONSIBILITY FOR QUALITY RESEARCH BEFORE USING ANY INFORMATION ON THE WEBSITE. DUTYBELL IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE OF ANY KIND CAUSED BY THE USE AND/OR TEMPORARY OR PERMANENT INTERRUPTION OF ITS SERVICES. NOTWITHSTANDING ANY PROVISIONS TO THE CONTRARY IN THIS WEB PAGE/DOCUMENT, DUTYBELL SHALL NOT BE RESPONSIBLE TO YOU FOR ANY REASON, REGARDLESS OF THE NATURE OF THE CLAIM, IT IS ALWAYS LIMITED TO THE DUTYBELL AMOUNT (IF ANY) YOU PAID FOR DUTYBELL SERVICES DURING THE MEMBERSHIP PERIOD.

Member Disputes

Members are solely responsible for their interaction on Dutybell. We reserve all rights, but no obligation, to follow up any disputes between any members. Dutybell.com does not participate in any litigation between any member and any other registered members. Dutybell.com always abide by the orders of the government/judicial authorities and fully cooperate in this process, but in this case, the related expenses will be reimbursed by the party involved in the Dutybell.

Governing Law and Jurisdiction

This agreement and any disputes or problems caused by accidental use of Dutybell.com are governed by Indian law, All members and companies are submit to the exclusive jurisdiction of the court located in Bengaluru,India. This agreement is accepted when you use this website and is further confirmed by the members of Dutybell, including the entire agreement between you and Dutybell regarding the use of this website and / or services. If any clause of this Agreement is invalid,, the rest of this agreement will still be in full force and fully effective.

By visiting or using the Dutybell Service, You agree that:

• the laws of India that will govern these Terms of Use and any dispute arise between you and Dutybell or any of its affiliates.
• any litigation between you and us shall be filed to confidential arbitration exclusively in the state courts located in Bengaluru, India for any proceeding, to the extent you have in any manner violated or threaten to violate Dutybell or any of its affiliate proprietary or intellectual property rights 
• we may seek injunctive or other appropriate relief in any state, any court of competent jurisdiction.

• Arbitration under this Agreement shall be conducted under the rules in accordance with the Arbotration and Concilation Act,1996 and other related Rules or laws. All proceedings of such arbitration shall be in the English Language Only.

• (v)In the event of litigation relating to these Terms to waive, to the maximum extent permitted by law, any right to a jury trial, except where a jury trial waiver is not permissible under applicable law.
• Any claim, action or proceeding by you related in any way to the Dutybell Service must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

Miscellaneous

The Dutybell terms, together with the data protection guidelines and other guidelines, constitute the entire agreement between you and Dutybell. They also represent the parties’ full understanding of the use of Dutybell services. Or enforcement of any of these conditions, including non-compliance with these conditions or other relevant documents, will not be considered a waiver or amendment of any terms or any other part of the terms of use. In some cases, any provision of these terms and conditions is deemed invalid or unenforceable. This provision will not be affected. Any provision in this document does not affect the validity of the remaining conditions. The remaining terms of use are still fully valid. All Dutybell rights not expressly granted in this document are reserved.
